Terms and conditions of participating in classes

TERMS AND CONDITIONS

Before coming to class, everyone is required to read the following Regulations.

Class attendance is equivalent to accepting the Regulations.

HOLACIRCO AERIAL GYMNASTICS SCHOOL REGULATION

INTRODUCTION

  1. The HolaCirco school (hereinafter referred to as "the School") teaches classes according to the schedule available at www.holacirco.es/horariosyprecios.

  2. The school belongs to:

GENERAL DISPOSITION

  1. The school offers individual and group classes for adults, teenagers, and children.

  2. Enrollment in the classes organized by the School is equivalent to accepting these Regulations.

  3. The learner agrees to comply with the rules and assumes all responsibility for their behavior inconsistent with its content.

  4. In the case of a minor, the regulations apply to their legal guardians.

  5. The school reserves the right to change the following regulations at any time.

  6. Information on changes in the Regulations will be provided on the website www.holacirco.es.

 

CLASS PARTICIPATION

  1. Participation in School classes will be allowed after purchasing:

    1. one ticket for an individual class;

    2. one pass with 4, 8, 12, and 16 tickets;

    3. one pass 1x per week, 2x per week, 3x per week, 4x per week

  1. A client who does not buy any of the forms of income above does not have the right to attend classes and use the services offered by the School.

  2. The client has the right to buy individual classes from an instructor at the School, to do so, please contact our School directly.

  3. Each employee of the School has the right to request the client to leave the classroom and the School buildings in case of his/her behavior violates the provisions of this regulation and prevents other clients from fully benefiting from the School's offer.

  4. Enrolling a child in classes is equivalent to giving: consent to participate in classes.

 

REGISTRATION

  1. You can sign up for classes organized by the school in one of the following ways:
    a) through the website: www.holacirco.es;
    b) sending an email to info@holacirco.es;
    c) sending a message through Messenger to the school's Facebook fanpage: www.facebook.com/HolaCirco;
    d) through the contact form at www.holacirco.es/contacto;
    e) on-site, before or after classes.

  2. The number of places in groups is limited.

 

PAYMENTS

  1. Within 7 days following the registration date, payment must be made for the classes or courses selected for the amount according to the price list on the School's website.

  2. The payment is a guarantee of a place reservation in selected classes or in a selected group.

  3. If payment is not made within 7 days of the registration date, the reservation of a place in the selected class or course will be canceled and the person will be removed from the list.

  4. Payment can be made:

 

    • by bank transfer to the school account:

  • in this case, please send the payment confirmation to the email address: info@holacirco.es, and in the case of signing up for individual classes, you must indicate the name, date, and exact time of the selected classes in the transfer title.

    • in cash to an instructor or at the front desk, before classes;

  1. A person who has purchased the single ticket is entitled to an additional payment up to the total value of the pass (and corresponding savings). The additional payment must be made at least 1 day before the next classes of the given group. Additional payments cannot be made at later dates.

  2. Subscription discounts and promotions offered by the School can not be combined.

  3. Validity of the passes:

    1. A single entry: 35 days from the date of purchase;

    2. The multi-entry pass (4, 8, 12, 16): 35 days from the date of purchase;

    3. The OPEN STUDIO: 35 days from the date of purchase;

    4. Passes - 1x a week, 2x a week, 3x a week, and 4x a week - are valid for one calendar month.

 

CANCELLATION, POSTPONEMENT OF CLASSES, OR GROUP DISSOLUTION

  1. In the case of:

    1. insufficient number of people required to carry out the activities of the group;

    2. sudden indisposition of the instructor;

    3. other reasons beyond the control of the School;

the School reserves the right to cancel classes, postpone the start of the course or cancel the group.

2. In the above cases, the persons who have made the payments have the right to:

    • People who made a payment for a single ticket:

      • a full refund of classes;

      • use of the ticket as part of other activities indicated by the school.

    • People who bought a subscription for a specific group:

      • return a part of the amount of the value equal to the individual classes (f.e. 80 euro / 4 tickets = 20 euro / 1 ticket);

      • extend the validity of the pass for a period that allows its full use.

Class refunds are made in the same way they were paid.

  1. The school does not accept returns of passes and does not refund money for unused classes if the responsibility is on the part of the client (illness, moving, change of schedule at work/school, etc.).

  2. The client has the right to a free canceling/postponement of the reserved classes: 12 hours before their start. A later resignation results in the exploitation of the ticket.

  3. In exceptional cases (pregnancy, injury), it is permissible to suspend the subscription after informing the School by email.

  4. In the event that, for reasons beyond the control of the School, it is not possible to hold the classes (epidemic, natural disaster, etc.), the School allows the subscription to be suspended until the activity resumes. In such situations, the School will inform clients by email, on the website, and on social networks.

 

SECURITY

  1. For the safety and comfort of all participants in the School's classes, each client is required to obtain their own clothing and footwear appropriate for the type of activity selected.

  2. Information on appropriate footwear and clothing can be obtained from the instructor or on the website.

  3. One can enter the room only with changeable shoes, appropriate for the selected type of classes, or without shoes, if there are no contraindications to this and the person conducting the classes agrees. Otherwise, the instructor has the right to ask the student to leave the room.

  4. For all classes at the School, please do not use body lotions and oils, lip gloss, and other colored cosmetics before exercising.

  5. The School is not responsible for the accidents of the participants during the classes (for example, injuries) that occur on the premises of the School. For all injuries, micro-injuries, or contusions during classes:

- of minors - the legal guardian assumes responsibility;

- as adults - they themselves take responsibility.

  1. Before buying the ticket to the classes organized by the School, each client must:

    1. verify his/her state of health and find out about possible contraindications for participation in the physical activities offered by the School;

    2. know the collateral effects of the exercises in selected classes, such as bruises, abrasions, and calluses, so as not to blame the School for it;

    3. the person who enrolls in the course or the legal guardian who enrolls the child in the course must check his/her health status beforehand.

  1. The School does not insure Students against unfortunate accidents. The participant of the classes should insure himself/herself. It is recommended that a participant in sports activities have a valid accident insurance policy. The scope of the insurance must cover all accidents, the consequences of which may be loss of life or health, the consequences of sports injuries, the costs of medical treatment and rescue, and civil liability insurance for damage to persons and property caused during sports activity.

  2. The coaches who conduct the classes are not responsible for the consequences of accidents that arise for the participants during the sports activities organized by the organizers in accordance with all sports regulations.

  3. Participants - and in the case of minors, parents, and legal guardians - undertake to provide updated information on their state of health and on their contraindications to exercise. The participant's attendance in sports classes is equivalent to confirming that there are no contraindications for practicing sports.

  4. Both the participants and the parents and legal guardians of the minors recognize and accept the direct physical contact of the pedagogue with each participant of the sports activities during the corrections of the exercises and the assurances resulting from the specificity of the classes.

  5. The student has the right to bring valuables or personal items to the room where the classes they have purchased are taught. The school is not responsible for damages related to the damage or theft of objects left in the locker by the participant in sports activities during the duration of the same and immediately before and after them.

 

OTHER PROVISIONS

  1. The client assumes all financial responsibility for damage to School facilities caused by the client's deliberate actions.

  2. Only the instructor who teaches the classes and the students of a certain group will be able to remain in the classrooms during the classes.

  3. There is a total prohibition on smoking, drinking alcohol, and possessing and using drugs or other intoxicants on the School premises.

  4. Persons who entered the study area in a state indicating the use of alcohol, drugs, or other intoxicating substances are strictly prohibited from participating in School activities and will be asked to leave the School.

  5. Issues not covered by the above regulations must be communicated and clarified via email: info@holacirco.es.

 

PERSONAL INFORMATION

  1. Informative clause

The administrator (the entity that determines the purposes and methods of processing personal data) is Kacper Krzymowski, PLAZA Marugame 3, Bloque B, Portal 3, Piso 2, 20018, Donostia-San Sebastian, Gipuzkoa, Pais Vasco, SPAIN, NIF: Y9495136Z, info@holacirco.es.

The personal data provided in the contact form and at the time of registration for classes, including name, surname, date of birth, email address, and telephone number, will be processed in order to provide the requested services and for informational and marketing purposes. The legal basis for the processing is the consent of the interested party. The recipients of the data will also be the entities providing hosting and legal services. Providing the data is voluntary. The data will be processed until the purpose for which they were collected ceases to exist or until the opposition to the processing of the personal data of the interested party ceases to exist, whichever occurs first. Every person has the right to request the Administrator access to personal data, rectify them, delete them, limit the processing, as well as the right to transfer the data and oppose the processing. Every person has the right to withdraw the consent for the processing of personal data that they have granted to the Administrator. The withdrawal of consent does not affect the legality of the treatment carried out before its withdrawal. Everyone has the right to file a claim with the Spanish Data Protection Agency - AEPD. The scope of personal data processing includes data profiling. The results of the activities referred to in the previous sentence are the selection of a commercial offer and the possible sending of marketing correspondence or the emission (display) of personalized advertising in terms of your interests. Objections to profiling activities, as well as any other rights of the data subject, can be made by submitting a statement using the contact details of the Administrator (School).

  1. By enrolling in classes at the School, you consent to the processing of your personal data by Kacper Krzymowski, PLAZA Marugame 3, Bloque B, Portal 3, Piso 2, 20018, Donostia-San Sebastian, Gipuzkoa, Basque Country, SPAIN, NIF: Y9495136Z, for information and marketing purposes in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council, of April 27, 2016, regarding the protection of natural persons with regard to the processing of personal data on the free circulation of these data and the repeal of Directive 95/46/EC (General Data Protection Regulation or GDPR).

  2. Enrollment in the School's classes is equivalent to giving consent to the free use of the image of the participant (including the minor whose registration is made by their legal guardian) by Kacper Krzymowski, PLAZA Marugame 3, Block B, Portal 3, Floor 2 , 20018, Donostia- San Sebastian, Gipuzkoa, Basque Country, SPAIN, NIF: Y9495136Z, for information and promotion purposes related to the activities of the School, in the form of photos, videos, works, including those published on websites or networks companies and cooperating partners.
